CONSTITUTIONAL LAW & THE LEGAL FRAMEWORK FOR PROTECTING ENVIRONMENT

ABSTRACT 

Our charter is not an inert however has grown and developed over time. In the Indian scenario, environment safety, has not most effective been raised to the popularity of fundamental law of the land, however it has additionally been webbed with human rights method and is now taken into consideration as a properly-set up fact that it's miles the fundamental human right of each individual, to live in a pollutants free environment with whole human dignity. The preamble to our constitution gives for a socialist society which promotes environmental safety. The fundamental responsibilities once more genuinely impose obligation on all residents to shield environment. The Directive standards further are directed toward the ideals of building a welfare kingdom. Healthy environment is one of the essential elements of a welfare nation. Article 47 states that the State shall regard the raising of the extent of vitamins and the standard of living of its human beings and the improvement of public fitness which includes the safety and improvement of environment as part of its number one responsibilities. Article forty eight-A of the charter states that the nation shall endeavor to defend and enhance the environment and to guard the forests and wild existence of the us of a. Part III guarantees essential rights which are crucial for the improvement of an individual. A citizen cannot keep on commercial enterprise interest if it is miles fitness hazards to the society or standard public. The paper meticulously offers inside the remedies under Article 36 and 226 and bureaucracy a perception for the reader that understanding of those provisions is necessary to bring extra public participation, environmental recognition among the loads.
